Terms of Use

These Terms of Use apply to the Happy Tree Games website (happytreegames.com) and to the mobile games published under the Happy Tree Games name, including their free and Plus editions (together, the "Games"). By using the website or a Game you accept these terms. If you do not agree with them, please do not use the website or the Games.

1. Who we are

The website and the Games are provided by Imre FARKAS, a private individual (natural person) from Odorheiu Secuiesc, Harghita County, Romania, who publishes the Games under the name Happy Tree Games, a project of Emma Wolf ("we", "us"). Contact: hello@emmawolf.com.

2. App store terms

You obtain the Games from Google Play or the Apple App Store. The terms of the store you use (for example the Google Play Terms of Service or Apple's Licensed Application End User License Agreement) also apply to your use of the Game; these Terms of Use add to them. Purchases, including the purchase of a Plus edition, are made with the store, which handles payment, billing and refunds under its own rules.

3. Licence to use the Games

We grant you a personal, non-exclusive, non-transferable and revocable licence to install and use the Games on devices you own or control, for your own non-commercial entertainment. You must not:

• copy, modify, sell, rent, sublicense or distribute a Game or any part of it;
• decompile, reverse engineer or disassemble a Game, except where the law expressly allows it;
• remove, hide or interfere with advertisements, notices or the consent and privacy settings of a Game;
• manipulate results or submit scores to the leaderboards in any way other than by normal play;
• use a Game or the website in a way that breaks the law or harms other players, us or third parties.

4. Free editions, advertising and Plus editions

The free editions are financed by advertisements shown between rounds and delivered by Google AdMob. The advertisements come from third parties; we do not choose them individually and we are not responsible for the products or services they promote. How advertising uses your data, and how you can change your choice, is explained in our Privacy Policy.

The Plus editions contain no advertisements. Where available, they offer Game Center leaderboards, which are provided by Apple under its own terms.

5. Leaderboards and fair play

Leaderboard entries show your Game Center nickname and your result to other players. Please choose a nickname that does not offend others. We may remove results that are obviously the product of cheating, errors or manipulation, and we may reset leaderboards, for example after a change to the rules of a Game.

6. Intellectual property

The Games, the website and their content (including the program code, graphics, animations, videos, sounds, music, texts, game names and the Happy Tree Games and Emma Wolf names and logos) belong to us or to our licensors and are protected by copyright and other intellectual property laws. Third-party materials are used under their own licences. Apart from the licence in section 3, no rights are granted to you.

7. Your content

Pictures you use in a Game through the camera (for example in Movie Puzzle) stay on your device and remain yours; we do not receive them. If you send us feedback or ideas, you allow us to use them to improve the Games without any obligation towards you.

8. Health and safety

• Some Games contain flashing or fast-moving images. If you or a family member have ever had epileptic seizures or are sensitive to light, consult a doctor before playing, and stop playing immediately if you feel unwell.
• Games controlled by tilting or moving the device (for example 2048 Gyro) should be played only in a safe place, holding the device firmly, and never while walking, driving or in traffic.
• Take regular breaks. Parents should supervise the play of young children.

9. Availability and changes

We continuously develop the Games and the website. We may update, change or discontinue a Game, a feature or the website, and we cannot guarantee that they will always be available, uninterrupted or free of errors. Results and settings are stored on your device; they may be lost if you delete the Game or its data, change devices, or if your device fails.

10. Your rights as a consumer and liability

If you are a consumer, you keep all the rights that the law of your country of residence gives you, in particular the statutory rights concerning digital content (for example under Romanian Government Emergency Ordinance no. 141/2021 and EU Directive 2019/770). Nothing in these terms limits those rights.

The free editions are provided free of charge, "as is". To the extent permitted by law, we are not liable for indirect damage, loss of data or loss of game progress. We are liable without limitation for damage caused intentionally or through gross negligence, and for injury to life, body or health, as provided by law.

11. Links and third-party services

The Games and the website contain links to other websites and use services of third parties (such as Google, Apple and PayPal). Their own terms and privacy policies apply to them, and we are not responsible for their content.

12. Ending your use

You can stop using a Game at any time by uninstalling it. We may end your licence if you seriously breach these terms; in that case you must delete the Game.

13. Changes to these terms

We may update these terms when the Games, the website or the law change. The current version is always available on this page, with the date of the last update at the top. Changes do not apply retroactively.

14. Applicable law and disputes

These terms are governed by Romanian law. If you are a consumer, this does not deprive you of the protection of the mandatory rules of the country where you live, and you may bring a claim before the courts of that country. Please contact us first at hello@emmawolf.com: most questions can be solved quickly. Consumers in Romania can also turn to the National Authority for Consumer Protection (ANPC, anpc.ro).
